Roblox reportedly continues efforts to move child sexual abuse lawsuits out of court
Roblox is reportedly pushing to move child sexual abuse cases into arbitration, away from public scrutiny.
Video game platform Roblox has long been embroiled in ongoing turmoil, with parents of underage users suing the $40 billion company over allegations that it has failed to adequately enforce safety measures.
In recent years, cases of sexual exploitation and grooming involving minors on the platform have led to over a hundred lawsuits being filed against Roblox. These allegations have also prompted wider concerns about child safety among authorities, contributing to the platform being restricted or banned in several countries.
However, the legal battle has been protracted, with some cases effectively remaining in limbo. In February, around 800 parents signed a letter to Roblox demanding that the company stop attempts to keep cases out of court and away from public scrutiny through the use of its arbitration clause.
The company faced further criticism as it recently appealed rulings that blocked its efforts to force cases into arbitration. According to The Indiana Lawyer, Roblox has appealed several such decisions, making it increasingly unlikely that the matter will be resolved before the end of the year.
What is Roblox’s arbitration clause?
Roblox includes an arbitration clause within its Terms of Service, which allows disputes with users to be resolved through private arbitration rather than in open court.
Arbitration is a private legal process that replaces traditional court proceedings. It is binding for US-based users and requires disputes to be heard by a neutral third-party arbitrator, who issues a legally enforceable decision outside of a public courtroom.
While the process is often faster and more streamlined, it could lack the transparency and procedural safeguards of the court system, making it not ideal for victims in these cases.
As stated in Roblox Support, its User Terms contain:
“A BINDING, INDIVIDUAL ARBITRATION AND CLASS ACTION WAIVER. THIS MEANS THAT YOU GIVE UP THE RIGHT TO BRING AN ACTION IN COURT, INDIVIDUALLY OR AS PART OF A CLASS ACTION.”
While some major technology companies, such as Meta Platforms Inc. and Snap Inc., have in certain cases chosen not to enforce arbitration clauses, Roblox–along with Discord, which has been closely linked to the child abuse cases–has continued to seek the enforcement of arbitration in ongoing disputes.
Why is Roblox facing bans in some countries?
Roblox has been restricted or banned in several countries, including China, Turkey and Algeria. These actions have largely stemmed from concerns over child safety, particularly allegations of grooming and sexual exploitation on the platform involving minors.
One widely reported case involved an adult predator who allegedly targeted an eight-year-old girl, manipulating and threatening her into giving sexually explicit videos, and allegedly threatening he would kill her family if she did not comply.
There have been over a hundred lawsuits in which parents have looked to hold the company accountable for such incidents. Roblox, however, has denied the allegations and maintains that child safety remains one of its top priorities.
What has Roblox done to improve child safety?
In recent months, Roblox has introduced a range of massive safety measures to better protect underaged users’ experience.
These measures include restricting communication for unverified accounts, which require identity verification to unlock. The platform has also introduced age-segmented accounts, which will provide moderated content. Enhanced parental controls have also been rolled out.
